Terms of Service - Mantouku

Please read this Terms of Service (“TOS”) carefully before starting a commission with Mantouku (“Me”, “The Artist”). Listed below are the guides of use, reposting, and the clients rights on the commission. This TOS goes to all types of my commissions.
If the client (“You”) has a problem with the artist, the commission, or the TOS. Please contact me through Twitter, Instagram or Discord (ichi#2348).
GENERAL TERMS
CHARACTER ART

When Commissioning a character art, Please send me a character sheet OR when commissioning a character sheet or a character model from scratch, please provide the idea through images for references.

VROID MODEL
-
If the Commission is a 3d Vroid Model, I will only be accepting those with a complete character model or sheet.. Occasionally I may accept to create a model from scratch– but price may vary depending on the time taken and the complication of the request.

Some accessories of the character may be made in vroid using the hair function and not external softwares such as Blender.

Accessories made from hair are at first connected to the head, because of that, the model will be modified externally by the artist using UNITY, making the accessory attach to the body and not the head.

Only the .VRM file can be modified externally, meaning the .VROID file will not have the accessories attached to the body.

Once the commission is complete and the client has received the .VRM file, unless voluntary-- the artist will no longer modify the model both in vroid and externally as the commission is completed.

The client may still commission me again if they want changes in their old model, for example a new set of costume and/or more expressions.

OVERALL
-
Please write in a polite manner and avoid being rude.

Any nasty behavior or harassment to the artist will cause a cancellation or decline of the commission.

Unless I volunteer or are paid to do so, I will not rush commissions.

I will only draw in my style and not other artists.

Unless explicitly asked not to by the client, I will post the commissioned art.
DO’S AND DON’TS
-
I will not do overly complicated characters as Vroid Studio is very limited when it comes to its resources.
-
I don’t do gore and nsfw.
-
I don’t do mecha.
-
I will do full art, lineart and flats and sketches.
-
I will do Icons, wallpapers, emotes and 3d models.
PAYMENT
-
Please do not send me your payment before I have agreed to accept the commission.

The currency accepted will only be USD and sent through paypal only.
-
Commissions can be paid 100% upfront or split 50% before and after the commission is done.
-
I will not work on the commission if it is not yet paid.
-
If the commission is going to be used commercially, the client will have additional charges.
PROCESS AND DELIVERY

Once the artist starts the commission, I will send the client a dm to notify the start of the commission. Once started the client will lose the rights for a refund.

In the progress of the sketch and clean sketch phase, the artist will send bad quality images to show the client and ask for their opinion, in this phase you will be given a maximum of 3 revisions. Wanting more revisions will cost a maximum of $10.

For the Line art, Coloring and the Final state, I will send more images to show the client that I am still working on it.

The turnaround time may vary based on the type of the commission, starting with 3 days to 2 week max.

The artist will let you know if there will be a delay to the submission of the commission. If the commission has yet been started, the client is ok to ask to get a refund.

When the commission is completed, the artist will send another bad quality image of the art to show the client it is done, to receive the commission, the client will pay the half other price (if not full) and once received, the HD/transparent image of the commission, or in the case of the 3d model, the vrm file. Will be posted on a google drive folder.
REVISIONS

The client has a maximum of 3 revisions.

If the client has reached the maximum revisions and wants to change more, they will be charged an additional $5 for 1 revision and $10 for 2, max. Further requests will be denied.
REFUND & CANCELLATION POLICY

Once the commission has been started, the client is no longer allowed to ask for a refund.

If the artist couldn’t start the commission on the given time or if it was cancelled before the start, the client is allowed to ask for a full refund.

When getting a refund, please do not get it directly from paypal as I will transfer the money to you myself.

If the client requests a Paypal chargeback after I start to work on the commission you will lose all aforementioned rights to the commissioned work and the artist will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

Tips are non-refundable.
COPYRIGHT & USAGE POLICY
The client is allowed to:

If paid the commercial fee, the client is allowed to use it commercially, be it on streams, merch or any monetized action.

Claim the character commissioned as their own.

Use the character to promote yourself.
The client is not allowed to:

Use the commission commercially if the client didn’t pay for the commercial fee.

Alternation of the commission without permission.

Claiming the art is yours.
CUSTOMER SATISFACTION

I will do my best to reach my client’s expectations.

If the client finds any problem in regards to the commission, please tell me right away so we can fix it and sort the problem out.

When it comes to my terms, I will be willing to change some if asked by the client from the start. For example, the client may ask for me not to post the commission for any reason said.
If the client breaks any of the terms provided above, based on the severity, they will not be able to commission me OR lose the rights to the commissioned art made by Mantouku, the artist. Will have the rights to make a profit from the commissioned artwork.
